Medicaid Estate Recovery Limited to Medicaid provided to individuals 65 years of age or older or permanently institutionalized. Expanded to Medicaid provided to individuals 55 years of age and older.
Pursuing Estate Recovery Voluntary. Mandatory.
Undue Hardship Exception N/A Requires that provision be made to avoid imposing undue hardship as a result of estate recovery actions.
